HONDURAS FILING REQUIREMENTS

PATENTS AND UTILITY MODELS
An application in writing must be filed before the Honduran Trademark & Patent Office. Said application must include:

Name and address of the applicant
Place of Incorporation of the applicant (if it is a juridical person)
Title of the invention or of the utility model
The name and address of the inventor(s) if it/they are not the applicant(s). In this case and if the inventor(s) do not work for the applicant, a fully legalized (up to a Honduran Consulate) deed of assignment of rights will also be required
The date, serial number and office where the applicant has previously filed an application for the same patent or utility model
Two sets of the description
Two sets of the claims
Two sets of the drawings (if applicable)
Two sets of the summary
Power of Attorney (Legalized by a Honduran Consulate)

INDUSTRIAL DESIGNS
An application in writing must be filed before the Honduran Trademarks & Patent Office. The said application must include:

Name, Nationality and address of the applicant. If the applicant differs from the designer, then we must also indicate the form in which it acquired the rights over the design.
Three (3) graphic of photographic representations of the Industrial Design. In the case of bi-dimensional designs incorporated in a flat surface, the representation shall be substituted with an actual material sample featuring the design for which protection is requested.
Precise indication of the kind or gender of the products to which the design will be applied and the class and subclass of these products.
Power of Attorney (legalized up to a Honduran Consulate).

APPELLATIONS OF ORIGIN

Name, address and nationality of the applicant or applicants and precise indication of the location of the manufacturing or production facilities are located;

The name of the Appellation of Origin for which registration is requested;

The Geographical area of production/manufacture to which the Appellation of Origin refers;

Products to which the Appellation of Origin is used;

Brief description of the essential qualities or characteristics of the products for which the Appellation of Origin is used; and,

Power of Attorney (legalized up to a Honduran Consulate).

The application for the registration of an Appellation of Origin shall be accompanied by the generic name of the respective product(s) or an expression relating to this product, but the protection conferred by the Law will not be extended to the generic name and/or expression used.

MARKS AND SLOGANS

An application in writing must be filed before the Honduran Trademark & Patent Office.

Said application must include:

Name, nationality and address of applicant. If the applicant is a juridical person (corporation) a legalized (up to a Honduran Consulate) copy of its Certificate of Good Standing or excerpt of the applicant’s registration at the corresponding Register of Companies will be required
Twenty prints of the mark / slogan
Description of the mark, the international class and the goods/services intended to cover and in the case of slogan we will also need besides the above, the precise indication of the mark(s) in connection which the slogan will be used.
Certified copy of the application/registration upon which priority is to be claimed (if applicable)
Power of Attorney (legalized up to a Honduran Consulate)
